The U.S. Food and Drug Administration (FDA) issued warning letters to three distributors: ABS Distribution Inc., EC Supply, Inc. And Easy Wholesale, LLC. The reason given by the FDA is that they sell and/or distribute a variety of unauthorized e-cigarette products. These illegal products include the popular e-cigarette products Elf Bar/EB Design, Esco Bars and Puff Max, which are popular with young people.
In this regard, the two supremacists contacted the relevant responsible department of Love Miracle after learning this news, Love Miracle said:
“Aware of the action taken by the FDA on July 27. Love Miracle understands that our U.S. e-cigarette distributors adhere to the law while providing responsibly produced, high quality products to retail customers. At the same time, Love Miracle has been supporting our distribution partners and commercial partners and working with regulators to address these issues.”
FDA steps up regulation
Dr. Brian King, director of the FDA’s Center for Tobacco Products (CTP), said the FDA is committed to keeping a close eye on the rapidly evolving e-cigarette industry, including through a variety of scientific means to quickly identify products that are popular with young people.
“We will continue to take a data-driven approach to action across the supply chain, including cracking down on the distribution of illicit products between manufacturers and points of sale.”
The distributors involved are suspected of violations
The distributors who received the warning letters are selling and/or distributing e-cigarette products in the United States that are not authorized by the FDA, which is prohibited under the Federal Food, Drug, and Cosmetic Act.
All the brands listed in these warning letters have been identified as the most popular e-cigarette products among young people in the United States.
The warning letter is part of a series of steps the FDA has taken across the supply chain to address these brands that are popular with young people. Other recent actions include:
Issue a warning letter to the company responsible for Esco Bars
Issued warning letters to retailers and distributors about Puff products
Issue warning letters to retailers regarding Elf Bar/EB Design and Esco Bars products
An import warning is issued for all Elf Bar/EB Design and Esco Bars products
Ann Simoneau, director of the FDA’s Office of Compliance and Enforcement, said:
“A warning letter is usually the first step after an inspection reveals a violation. We will monitor to ensure these violations are corrected, and if they are not corrected promptly, recipients will face further action such as civil fines, seizures and bans.”
To achieve voluntary compliance, companies receiving the warning letter have 15 business days to respond to the steps they will take to correct the violation and prevent future violations. Most of the companies that received the warning letters voluntarily took corrective action. However, failure to correct violations in a timely manner may result in FDA taking additional actions such as injunctions, seizures, and/or civil fines.
In the past year, the FDA has issued its first injunctions and civil fines against e-cigarette manufacturers. The Agency intends to make these actions a regular part of its enforcement portfolio; Since January 2023, for example, the agency has issued civil fines against 15 manufacturers for illegally selling e-cigarettes.
Enhancing FDA’s own regulatory capabilities
In addition to taking action against illicit products across the supply chain, the FDA said it will continue to evaluate and enhance its surveillance capabilities to best monitor the evolving market for tobacco products. For example, the FDA and the National Institutes of Health last month announced funding for a new Tobacco Rapid Surveillance Center. The center will complement the Tobacco Products Center’s internal monitoring efforts and provide additional rapid information to monitor changes in tobacco product markets and smoking patterns.
