According to the Licensing Law of Belarus, from January 1, 2023, the retail trade of non-tobacco nicotine-containing products and liquids for electronic cigarette systems will be licensed. The relevant regulations provide a transition period for the corresponding business entity to apply for a license.
The relevant regulations show that as of January 1, 2023, the above products have been retailed, and the relevant sales activities need to be ended before July 1. If you want to continue to sell, you need the corresponding channel license.
If a “retail of tobacco products” service is stated in the license before January 1, 2023, a notice will need to be submitted to the licensing authority by July 1, in the form prescribed by MART. If you do not already have a license, you must apply as soon as possible.
The Belarusian Tax Ministry stressed that since July 1, commercial entities that do not comply with the provisions of the law are not allowed to retail non-tobacco products containing nicotine and e-vapers; At the same time, the relevant business entities are reminded that if they do not have plans to continue sales, they must clear their stocks by July 1 or face administrative penalties under Article 13.3, Part 1 of the Code of Administrative Offences of Belarus; Or according to the criminal act provided for in Article 233 of the Criminal Code of Belarus.
